04 Sep Public Notice: Registration procedure by-law 526.19-2025
To interested persons entitled to sign an application to take part in a referendum
PUBLIC NOTICE is hereby given by the undersigned, Town Clerk of the Town of Hudson, of the following:
Following the public consultation meeting held on August 14, 2025 pertaining to the first draft By-Law 526.19-2025, Council adopted, without changes, at its regular meeting held on September 2, 2025, the second draft by-law entitled “By-law 526.19-2025 to amend the zoning by-law in order to modify the provisions related to air conditioning units and heat pumps”.
The purpose of this draft By-Law is to allow air conditioning units and heat pumps in the front yard for multifamily or mixed-use buildings.
It is subject to approval by way of a referendum with regards to the following provisions:
- Section 1: To authorize air conditioning units and heat pumps in front yards exceeding the minimum size.
- Section 2: To establish conditions under which air conditioning units and heat pumps are permitted in secondary front yards.
A request concerning this draft By-Law may come from any zone within the Town’s territory. A map identifying the zones can be consulted on the town’s website as well as at the Town Hall, during opening hours.
CONDITIONS OF VALIDITY OF ANY REQUEST
In order to be valid, an application must:

- clearly indicate the provision to which it relates and the zone from which it originates; and, when applicable, the zone in respect of which the request is made;
- be received at Town Hall, located at 481 Main Road, Hudson or by email at greffe@ville.hudson.qc.ca or the mailbox located at the same address no later than September 12, 2025; and
- be signed by at least twelve (12) interested persons in the zone from which it originates or by a majority if their number of interested persons in the zone does not exceed 21.

CONDITIONS FOR BEING AN INTERESTED PERSON ENTITLED TO BE INCLUDED ON THE REFERENDUM LIST:
Is an interested person:

- any person who, on September 2, 2025 is not disqualified from voting under section 524 of the Act respecting elections and referendums in municipalities and who meets the following conditions:
- is domiciled in a zone from which the application originates;
- has been domiciled for at least six (6) months in Quebec;
- be the age of majority and a Canadian citizen and not be disqualified from voting by virtue of a judgment rendered under section 288 of the Civil Code of Québec
- any sole owner of an immovable or sole occupant of a business establishment, not disqualified from voting and who meets the following conditions:
- has been an owner of an immovable or occupant of a business establishment situated in the zone from which an application may originate at least since September 2, 2025;
- be the age of majority and a Canadian citizen, and not be disqualified from voting by virtue of a judgment rendered under section 288 of the Civil Code of Québec.
- having filed, or file at the same time as the application, a written document signed by the owner or the occupant requesting that his or her name be entered on the referendum list, as the case may be;
- any undivided co-owner of an immovable or co-occupant of a business establishment not disqualified from voting and who meets the following conditions:
- has been undivided co-owner of an immovable or co-occupant of a business establishment situated in the zone from which an application may originate at least since September 2, 2025;
- be designated, by means of a power of attorney signed by the majority of persons who have been co-owners or co-occupants for at least since September 2, 2025, as being the one having the right to sign the application in their name and be entered on the referendum list, as the case may be. The power of attorney must have been filed, or must be filed with the application.
- be the age of majority and a Canadian citizen, and not be disqualified from voting by virtue of a judgment rendered under section 288 of the Civil Code of Québec.
- any person who, on September 2, 2025 is not disqualified from voting under section 524 of the Act respecting elections and referendums in municipalities and who meets the following conditions:
In the case of a legal person, one must:

- designate by resolution one of its members, directors or employees who, as of September 2, 2025, is of full age, a Canadian citizen, not under curatorship, nor disqualified from voting under the law;
- having filed or file the resolution with the application, designating the person authorized to sign the application and to be entered on the referendum list, as the case may be.
Except in the case of a person designated to represent a legal person, a person shall have his or her name entered on the list in only one capacity, as per section 531 of an Act respecting elections and referendums in municipalities.
Information to determine which interested persons are entitled to sign an application and how to exercise this right can be obtained by contacting the Clerk’s office.
The provision in the second draft by-law to which no valid application is received may be included in a by-law that is not required to be submitted to the approval of qualified voters.
The second draft of By-Law 526.19-2025 may be consulted on the Town’s website and at Town Hall, at 481 Main Road, Hudson, during working hours which are from 8:00 a.m. to 12:00 p.m., from Monday to Friday and from 1:00 p.m. to 4:30 p.m. from Monday to Thursday.
